
Under normal circumstance, when an incident occurs at licenced
premises the police are requested to attend and deal with
the situation and the offender. You may then be asked to
supply the officer dealing with the incident with a statement
of events. It is at this point that you should ask the officer
to include in that statement that you would like the courts
to issue an Exclusion Order against the offender when s/he
is found guilty and sentenced. The courts will then take
into consideration when the offender appears before them.
When an exclusion order is imposed the Licensing Department
will be informed and any available photograph of that person
will be published in accordance with the guidelines in the
tri-annual publication 'The Gallery'

In order to standardise the
procedure towards obtaining a Sheffield LicenceWatch exclusion
order the following actions must take place.
If an incident occurs on or
nearby licensed premises, which result in the licensee either:-
Ejecting the offender or
Requesting police assistance
to eject the offender
AND
The incident is of such a
nature that the licensee feels he/she should be excluded
from all licensed premises in the zone or area. He should
forward a letter to the committee or the Police Liaison
Officer outlining the circumstances of the incident. A pro-forma

The contents of the letter
will be outlined to the committee prior to the next meeting.
The licensee is invited to that meeting to outline the circumstances
personally, if they wish. A decision as to whether or not
that person should be excluded will then be made.
If the decision is to exclude,
a letter will be sent to the offender informing him / her
of the decision.
Should
that person then enter licensed premises they should be
asked to leave immediately. Should
they refuse the Police should be contacted with a request
for assistance to eject that person.
In order that all licensees
are aware of the committee decision the details will be
published in the next issue of 'The Gallery', together with
a photograph (if available)

If an incident occurs on licensed
premises and the Police are requested to attend and arrest
any person, the licensee should contact the arresting officer
either at the time (if practicable) or immediately after
the incident, and request that a court exclusion order be
sought on that person.
When the offender attends
court the Magistrates will consider the circumstances and
a decision will be taken whether or not to impose a Court
Exclusion Order.
If a court order is imposed,
and that person enters licensed premises, the licensee should
ask that person to leave the premises. The police can also
be contacted with a request that he / she be ejected. If
the licensed premises concerned happen to be one of those
listed on the exclusion order, the police can then take
further action as he / she is in contravention of a Court
Order.
Licensees must ensure that
all staff are made aware of current Exclusion Orders within
the city. Photographs are published tri-annual in 'The Gallery'
and all staff should be encouraged to view this publication.
